Terms and Conditions of Sale

By confirming the purchase order, the User accepts and declares having read, understood, and accepted the General Terms and Conditions of Navigation and Use of the Website and authorizes Gemignani Tartufi S.r.l. to process the personal data provided during registration on the Website at the time of purchase, as well as to transmit to Gemignani Tartufi the personal data necessary for payment processing according to the methods indicated.

1. Object

These general terms and conditions of sale govern and apply to the purchase of Gemignani Tartufi brand products through the e-commerce site www.gemignanitartufi.it, owned and operated by Gemignani Tartufi S.r.l., and must be carefully reviewed by the customer before completing the purchase process.

By placing a purchase order, the customer unconditionally accepts and undertakes to observe these general terms and conditions of sale, as well as the payment terms set forth below, in their dealings with Gemignani Tartufi. They declare that they have read and accepted all the information provided. They also acknowledge that Gemignani Tartufi shall not be bound by any terms and conditions other than these unless previously agreed to in writing.

All sales, delivery, and payment terms are listed in detail in the various sections of the Site and are considered an integral and essential part of this contract. The terms and conditions applicable to each individual order will be those displayed on the Site at the time of ordering. Any new terms and conditions will be effective upon publication on the Site and will apply only to sales concluded subsequently.

The Site is dedicated to retail sales and, as such, is intended for the exclusive use of Consumers.

Customers visiting the site www.gemignanitartufi.it must review these terms and conditions online before confirming their purchases. Submitting an order confirmation therefore implies full knowledge of these terms and conditions and their full acceptance.

Before confirming the purchase, the Customer will be shown a summary of the unit cost of each chosen product, the total cost in the case of purchasing multiple products, and shipping costs.

Upon confirming the purchase, upon completion of the transaction, the Customer will receive an email containing the order number, date, and total amount.

Any communication from the Consumer connected and/or related to the purchase of the Products, including any reports, complaints, requests concerning the purchase and/or delivery of the Products, the exercise of the right of withdrawal, etc., must be sent to the Seller using the contact details and methods indicated on the Website, to the email addresses shop@gemignanitartufi.it and gemignanitartufi@pec.cgn.it.

The customer who places the order will receive, at the end of the process, a confirmation that the order proposal has been entered into our information system. Confirmation of the order’s acceptance or rejection (for accounting or administrative reasons, or due to product shortages) will be sent subsequently via email to the email address provided by the customer.

2. Product Characteristics and Availability

The Products are sold with the characteristics described and according to the general conditions of sale published on the Site at the time the order is placed by the Consumer.

The Seller reserves the right to modify these general conditions of sale at any time at its sole discretion, without prior notice to Site users. Any changes made will be effective from the date of publication on the Site and will apply only to sales concluded on or after that date.

Prices, Products for sale on the Site, and/or their characteristics are subject to change without notice. Before placing the purchase order, the Consumer is advised to check the final sale price.

The Site can be accessed worldwide. However, the available Products can only be purchased by users requesting delivery to one of the countries listed.

3. Unavailable Products

In the event of unavailability of certain products for reasons unforeseeable at the time of order confirmation, the owner will refund the user the amount for the unavailable products ordered.

4. Product Purchase Procedures

The purchase order submitted by the Consumer to the Seller via the Website constitutes a contractual proposal and is governed by these General Terms and Conditions of Sale, which form an integral part of the order itself and which the Consumer, by submitting the order to the Seller, is required to accept in full and without reservation.

Before purchasing the Products by submitting the purchase order, the Consumer will be asked to carefully read these General Terms and Conditions of Sale and the information regarding the right of withdrawal.

The Consumer’s purchase order is accepted by sending an order confirmation email via PayPal, which will contain a summary of the order and a description of the characteristics of the Product ordered.

Every purchase contract for the Products is deemed concluded when the Consumer receives the order confirmation from the Seller via PayPal.

5. Product Selection and Purchase Procedure

The Products presented on the Site may be purchased by selecting the Products of interest to the Consumer and adding them to the virtual shopping cart. Once the Consumer has completed the Product selection, to purchase the Products added to the cart, they will be redirected to the PayPal payment site, where they will provide the required information to complete the order and finalize the contract. Finally, by clicking the “Confirm and Pay” button, the Consumer will be asked to confirm their order, which will then be sent to the Seller.

The purchased goods will be shipped in suitable packaging and accompanied by a shipping document. The package will be shipped via courier and delivered to the customer’s home.

6. Delivery of Goods and Acceptance

The order submitted by the Customer will be binding on Gemignani Tartufi only if the entire order process has been completed properly and correctly, without any error messages being displayed on the Website. Gemignani Tartufi will not include products not expressly requested by the Customer.

Gemingnani Tartufi undertakes to do everything within its power to comply with the delivery times indicated on the Website and, in any case, to deliver within a maximum of 30 days from the day following the day on which the Customer placed the order. In the event of non-fulfilment of the order by the Seller due to the unavailability, even temporary, of the Product, the Seller will provide written notification to the Consumer and will refund any sums already paid by the Consumer for the Product.

The Products ordered by the Consumer will be shipped using the shipping method selected by the Consumer, from those available and indicated on the Website at the time the order is placed.

If the packaging or wrapping of the Products ordered by the Consumer arrives at their destination visibly damaged, the Consumer is advised to refuse delivery by the shipping company.

7. Prices, Shipping Costs, Duties, and Taxes

The price of the Products is expressed in euros and is indicated on the Website when the Consumer places the order. Prices include standard packaging costs and VAT, but do not include shipping costs, which are the responsibility of the Customer and are separately highlighted in the order summary.

For deliveries to countries outside Europe, the Consumer is solely responsible for any additional costs, charges, taxes, and/or duties that a given country may apply for any reason to the Products ordered under these general terms and conditions of sale. The Consumer declares that lack of knowledge of the aforementioned costs, charges, duties, taxes, and/or duties at the time of placing an order with the Seller shall not constitute grounds for termination of this contract and that the Consumer shall not in any way charge Gemignani Tartufi for such charges.

8. Payments and Shipping

Product prices, expressed in euros, include VAT. Shipping costs will be added to these prices. These costs will be calculated during the purchase process and will vary based on the country of delivery and the weight of the package. Shipping costs are calculated automatically when you enter your details and select the destination area. Prices do not include any duties or taxes applicable in the country where the goods will be delivered; these additional costs will be borne by the buyer.

Payment must be made at the time of ordering via PayPal. The Consumer expressly agrees that the Seller’s performance of the contract will begin upon crediting the price of the purchased products to the Seller’s bank account.

The Seller will send the invoice in paper format in the envelope containing the transport documents accompanying the goods.

8. Payments and shipping

The transaction will be charged to the Customer’s credit card only after Gemignani Tartufi has confirmed the Product’s availability, verified the credit card details, and received authorization from the company issuing the Customer’s credit card. If, for any reason, it is impossible to charge the amount due by the Customer, the purchase process will be automatically canceled and the purchase will be automatically cancelled.

Shipping occurs within 72 hours of sending the order confirmation email to the customer.

Delivery will be made by courier, who will deliver the products within 7 business days of shipment to the address indicated by the customer upon registration. These delivery times apply to Italy; for deliveries abroad, delivery times may vary depending on the country and destination.

In any case, the products will be delivered within a maximum of 30 (thirty) days from the day following the conclusion of the contract, unless Gemignani Tartufi communicates—within the same period or by the agreed-upon delivery deadline, including by email—the impossibility of delivering the ordered Products due to the subsequent unavailability, even temporary, of the Products. In the event of such communication, Gemignani Tartufi will refund any sums already paid by the Customer for the supply.

9. Delivery Methods

Deliveries are made during the courier’s usual business hours to the address indicated by the user and according to the methods specified in the order summary. Upon delivery, the user is required to check that the package is intact. Ordered products will be delivered in sealed packages.

Gemingani Tartufi is not responsible for unforeseeable delays due to force majeure attributable to the courier, nor for incorrect or incomplete addresses provided by the customer when registering on the website.

10. Right of Withdrawal

The customer’s right of withdrawal is established by Legislative Decree 206/2005. The customer therefore has the right to withdraw from the contract, without incurring any costs, provided that the withdrawal is communicated by registered mail with return receipt to Gemignani Tartufi S.r.l., Viale G. Marconi, 89, 56028 San Miniato (PI) within 14 days of receiving the products.

The notification must be sent within the same timeframe via certified email to gemignanitartufi@pec.cgn.it, provided it is confirmed by registered mail within the following 48 hours. This notification must include:

Customer’s first and last name and address

Telephone number and email address

Order number

Specification of the product for which you wish to return the goods and the reasons for doing so (this may help us improve our service)

Copy of the invoice

The Customer must then return the product at their own expense to Gemignani Tartufi S.r.l.

If the right of withdrawal is exercised in accordance with the procedures described, Gemignani Tartufi will refund the amount paid for the purchase of the product as soon as possible and in any case within 30 days from the date on which Gemignani Tartufi became aware of the exercise of the right of withdrawal, provided that the goods are received intact within that period. The refunded amount will be net of shipping costs.

The right of withdrawal does not apply to the purchase of sealed packaged products opened by the Customer, or items that by their nature cannot be returned or are liable to deteriorate or expire rapidly.

Gemignani Tartufi reserves the right to refuse the return of any Products that do not comply with these requirements. Refunds will be issued using the same payment method used for the purchase. Furthermore, the customer will be responsible for the costs of returning the Products. Gemignani Tartufi will not be responsible for refunds or compensation for Products shipped by the Customer but never received by Gemignani Tartufi due to loss, theft, or damage not attributable to the latter.

If the terms and conditions for exercising the right of withdrawal are not complied with, the right to a refund of the amounts already paid to the Seller will not be granted. Therefore, unauthorized returns will not be accepted unless previously agreed upon.

11. Complaints

If a product is found to be broken or missing, or if an item does not conform to the customer’s requests, the customer has the right to request delivery or replacement of the missing or non-conforming product, or a credit against their subsequent purchase for an amount equal to the value of the disputed product(s). Reports of such anomalies must be made within 3 days of the delivery date.

Gemingnani Tartufi declines all liability for poor product condition due to inadequate storage after delivery.

12. Disputes

Any dispute relating to the application, execution, interpretation, and breach of the contract entered into online between the Customer and Gemignani Tartufi is subject to Italian jurisdiction. Any dispute between the parties in this regard shall be subject to the jurisdiction of the Court of the Customer’s place of residence or domicile, if located in Italy. If the Customer’s domicile or residence is not within Italy, the competent Court shall be that of Gemignani Tartufi’s registered office.

13. Intellectual Property Rights and Copyright

The Consumer acknowledges that all content on the Site, including documents, trademarks, names, as well as any distinctive signs, denominations, images, photographs, written text, or graphics used on the Site or relating to the Products, are and remain the exclusive property of Gemignani Tartufi. Access to the Site and/or the purchase of Products does not confer any rights on the Consumer.

The Site’s content may not be reproduced, in whole or in part, transferred by electronic or conventional means, modified, or used for any purpose without the prior written consent of Gemignani Tartufi.

All content is protected by copyright and trademark laws, and is protected by copyright.

14. Consumer Data and Privacy Protection

In order to place an order and therefore conclude this contract, the Consumer is required to provide certain information via PayPal, such as name, surname, shipping address, and telephone number. The Consumer acknowledges that the personal data provided will be recorded and used by the Seller, Gemignani Tartufi, in accordance with the provisions of Italian Legislative Decree no. 196/2003 and subsequent amendments (Privacy Code), to process each purchase made through the Site and, with the Consumer’s consent, for any additional activities as indicated in the specific privacy policy provided to the Consumer through the Site at the time of registration.

The Consumer declares and guarantees that the data provided to the Seller during the registration and purchase process are correct and truthful.
