Terms and conditions for sale and purchase

Confirming the purchase order, the User accepts and declares to have read, understood and accepted the General Conditions of Navigation and Use of the Website and authorizes Gemignani Tartufi S.r.l. to the processing of personal data communicated during registration on the Site at the time of purchase and to transmit the personal data necessary for processing the payment to Gemignani Tartufi in the manner indicated.

  1. Object

These general conditions of sale govern and apply to the purchase of Gemignani Tartufi branded products, through the e-commerce site www.gemignanitartufi.it owned by the Gemignani Tartufi Srl company, and managed by it, and must be carefully examined by the customer before completing the purchase process.
By submitting the purchase order, the customer unconditionally accepts and undertakes to observe these general conditions of sale in his relations with Gemignani Tartufi, as well as the payment conditions illustrated below, declaring that he has read and accepted all the information provided to him, and also acknowledges that Gemignani Tartufi does not consider itself bound to conditions other than the present ones unless previously agreed in writing.
All products and prices specified on the Site constitute an offer to the public with the limitations and procedures contained in the Site itself and in these general conditions.
All the methods of sale, delivery and payment are listed in detail in the various sections of the website and are to be considered an integral and essential part of this contract. The conditions applicable to each singular order will be those displayed on the Site at the time of the placement of the order. Any new conditions will be effective from the time of publication on the Site and will apply only to sales concluded subsequently.
The Site is addressed to retail and as such it is intended for the exclusive use of this category.
These purchase conditions must be examined online by customers visiting the website www.gemignanitartufi.it before they confirm their purchases. The forwarding of the order confirmation therefore implies full knowledge of these purchase conditions and their full acceptance.
Before confirming the purchase, the customer will be summarized the unit cost of each selected product, the total cost in case of purchase of multiple products and transport costs.
By confirming the purchase, upon completion of the transaction, the Customer will receive an e-mail message containing the number, date and total amount of their order.
Any communication from the Consumer connected and / or related to the purchase of the Products, including any reports, complaints, requests concerning the purchase and / or delivery of the Products, the exercise of the right of withdrawal, etc; must be sent to the Seller at the addresses and in the manner indicated on the Site and at the e-mail address shop@gemiganitartufi.it and PEC gemignanitartufi@pec.cgn.it .
The customer who sends the order will receive, at the end of the procedure, a communication confirming that the order proposal has been entered in our information system. The confirmation of the acceptance of the order or the refusal of the same (both for accounting, administrative reasons or for any product shortage), comes later by e-mail.

  1. Product characteristics and availability

The Products are sold with the characteristics described and according to the general conditions of sale published on the Site at the time the order is sent by the Consumer.
The Seller reserves the right to change these general conditions of sale at any time at its discretion, without the need to provide any notice to the users of the Site. Any changes made will be effective from the date of publication on the Site and will only apply to concluded sales starting from that date.
Prices, Products for sale on the Site and / or their characteristics are subject to change without notice. Before sending the purchase order, the Consumer is invited to check the final sale price.
The Site can be accessed from all over the world. However, the Products available can only be purchased by users who request delivery in one of the States that are indicated.

  1. Unavailable products

In the event of unavailability of some products for reasons not foreseeable at the time of order confirmation, Gemignani Tartufi will refund the user for the amount relating to the ordered and unavailable products.

  1. Procedure for purchasing products

The purchase order transmitted by the Consumer to the Seller through the Site has the value of a contractual proposal regulated by these general conditions of sale, which form an integral part of the order itself and that the Consumer, by transmitting the order, is required to accept fully and without term.
Before proceeding with the purchase of the Products, by sending the order, the Consumer will be asked to carefully read these general conditions of sale and the information on the right of withdrawal.

The Consumer’s purchase order is accepted by sending an e-mail confirming the order via PayPal, which will report the summary of the order placed and the description of the characteristics of the ordered items.

Each contract for the purchase of the Products is considered concluded when the Consumer receives the order confirmation by e-mail from the Seller via the PayPal service.

  1. Procedure for the selection and purchase of products

The articles presented on the Site can be purchased by selecting the Products of interest to the Consumer and placing them in the appropriate virtual shopping cart. After selecting the Products, to purchase the Products placed in the cart, the Consumer will be redirected to the PayPal payment site, where he will provide the required data to conclude the order and allow the completion of the contract. Finally, through the “Confirm and pay” button, the Consumer will be asked to confirm his order, which will then be sent to the Seller.

The purchased goods will be shipped in suitable packaging accompanied with a shipping document. The package will be shipped by courier and delivered to the customer’s home.

  1. Delivery and acceptance of goods

The order sent by the Customer will be binding for Gemignani Tartufi only if the entire order procedure has been completed regularly and correctly without any indication of error messages by the Site. Gemignani Tartufi will not include products not expressly requested by the Customer.

Gemignani Tartufi undertakes to do everything in its power in order to comply with the delivery times indicated on the Site and, in any case, to carry out the delivery in a maximum time of 30 days starting from the day following that in which the Consumer transmitted. In case of non-execution of the order by the Seller, due to the unavailability, even temporary, of the Product, the Seller will provide written notice to the Consumer and will refund any amounts already paid by the Consumer for the payment of the Product.

The shipment of the Products ordered by the Consumer will take place in way chosen by the Consumer, among those available and indicated on the Site at the time the order is placed.
Should the packaging or wrapping of the products ordered by the Consumer arrive at their destination clearly damaged, the Consumer is invited to refuse delivery by the forwarder.

 

  1. Prices, shipping costs, duties and taxes

The price of the Products is expressed in euros and is that indicated on the Site at the same time as the order is sent by the Consumer. The prices include standard packaging costs and VAT, while they do not include shipping costs which are charged to the customer and are clearly highlighted in the order summary.

In case of delivery to Extra-European countries, the Consumer is solely responsible for any additional costs, charges, taxes and / or duties that a given country may apply for any reason to the Products ordered on the basis of these general conditions of sale. The Consumer declares that the lack of knowledge of the costs, charges, duties, taxes and / or taxes referred to above at the time of sending an order to the Seller, cannot constitute grounds for termination of this contract and that he will not be able in any way charge the aforementioned charges to Gemignani Tartufi.

  1. Payment and shipment

The prices of the products, expressed in Euros, include VAT; to the latter will be added the shipping costs which will be calculated during the purchase process and which will vary according to the country of delivery and the weight of the packaging. The amount of the shipment is calculated automatically when, by entering the data, the destination area is selected. The prices do not include any duties or taxes foreseen by the country where the goods will be delivered: these additional costs will be borne by the buyer.

Payment must be processed together with the order with PayPal. The Consumer expressly accepts that the execution of the contract by the Seller will begin when the price of the products purchased is credited to the Seller’s current account.
The Seller will send the invoice in the package containing the transport documents accompanying the goods.

The transaction will be charged to the Customer’s credit card only after the availability of the Product has been confirmed by Gemignani Tartufi; after the credit card details have been verified and the debit authorization from the company that has issued the credit card to the consumer has been given.
In the event that, for whatever reason, the debit of the amounts due by the Customer proves impossible, the purchase process will be automatically canceled.
Shipping takes place within 72 hours after sending the order confirmation email to the customer.

Delivery will be made by courier who will consign the products within 7 working days after shipment to the address indicated by the customer at the time of registration. These times are valid for what concerns the Italian territory, while for deliveries abroad there may be variations based on the country and destination.

In any case, the products will be delivered within a maximum term of 30 (thirty) days from the day following the conclusion of the contract unless Gemignani Tartufi communicates – within the same term or by the latest agreed delivery date, also by e-mail – the inability to deliver the Products ordered following the unavailability, even temporary, of the Products. In the event of such communication, Gemignani Tartufi will refund any sums already paid by the Customer for the payment of the supply.

  1. Shipping methods

Deliveries are made during the usual working hours of the courier in charge at the address indicated by the user and in the manner specified in the order summary. At the time of delivery, the user is required to check that the package is intact.

The ordered products will be delivered in sealed packages.
Gemignani Tartufi is not responsible for unforeseeable force majeure delays to be attributed to the courier and for incorrect and incomplete addresses provided by the customer when registering on the site.

  1. Right of withdrawal

The Customer’s rights of withdrawal is sanctioned by Legislative Decree 206/2005. The Customer therefore has the right to withdraw from the contract, even partially, without explanation and without any additional costs, on condition that the withdrawal is communicated by registered letter with return receipt to Gemignani Tartufi Srl Via Cascina Lari 1/3/5, 56028 San Miniato (Pi) within 14 working days from the day of receipt of the products.

The communication must be anticipated, within the same term, by certified email to gemignanitartufi@pec.cgn.it , provided that it is confirmed by registered letter with return receipt within the following 48 hours. This communication must contain:

  1. Name, Surname and address of the customer
  2. Telephone number and e-mail
  3. The reference to the order number
  4. Specification of the product for which he wants to use the return and the reasons (this, possibly to help us improve our service)
  5. Copy of the invoice

The Customer must then return the product at his own expense by sending it to Gemignani Tartufi S.r.l Via Cascina Lari 1/3/5, 56028 San Miniato (Pi).
If the withdrawal has been exercised in accordance with the methods described, Gemignani Tartufi will refund the amount paid for the purchase of the product as soon as possible and in any case within 30 days from the date on which Gemignani Tartufi became aware of the exercise of the right of withdrawal, on condition that the goods have been received intact by the aforementioned term. The refunded amount will be net of delivery costs.

The right of withdrawal is not allowed in the case of the purchase of sealed packaged products, opened by the Customer and items which by their nature cannot be returned or are liable to deteriorate or expire rapidly.
Gemignani Tartufi reserves the right to refuse the return of those Products that do not comply with these requirements. Refunds will be made with the same payment method used for the purchase. In addition, the costs for returning the products will be charged to the customer. Gemignani Tartufi will not be liable for reimbursement or compensation relating to Products shipped by the Customer but which have never been received by Gemignani Tartufi due to loss, theft or damage that are not attributable to the same.

If the methods and terms for exercising the right of withdrawal are not respected, the right to reimbursement of the sums already paid to the Seller will not be issued, therefore returns that are not authorized and that have not been previously agreed will not be accepted.

  1. Complaints

In case the breakage, the lack of a product or the presence of an item that does not comply with the customer’s requests is proved, the Customer has the right to request delivery or reinstatement of the missing or non-compliant product or credit on the expenses of equal amount to the value of the disputed product or products. The communications of the aforementioned anomalies must be made within 3 days from the delivery date.

Any liability of Gemignani Tartufi for the poor condition of the products due to inadequate storage after delivery is excluded.

 

  1. Disputes

Any dispute relating to the application, execution, interpretation and violation of the online contract between the customer and Gemignani Tartufi is subject to Italian jurisdiction. For any dispute between the parties in this regard, the Court of the place of residence or domicile of the Customer is competent, if located in the Italian territory. If the customer’s domicile or residence is not within the Italian territory, the competent court is that of the Gemignani Tartufi headquarters.

 

  1. Intellectual Property Rights and Copyright

The Consumer declares to be informed that all the contents of the site, including documents, trademarks, names, as well as any distinctive sign, denomination, image, photograph, written or graphic text used on the Site or relating to the Products are and remain exclusive property of Gemignani Tartufi without the Consumer having any rights over them from accessing the Site and / or purchasing the Products.

The contents of the Site may not be reproduced, neither in whole nor in part, transferred by electronic or conventional means, modified, or used for any purpose without the prior written consent of Gemignani Tartufi.

All contents are covered by copyright and trademark protection legislation.

 

  1. Customer data and protection of privacy

In order to proceed with the forwarding of the order and therefore the conclusion of this contract, certain data are required from the Consumer, through PayPal, such as name, surname, shipping address and telephone number. The Consumer acknowledges that the personal data provided will be recorded and used by Gemignani Tartufi, in accordance with and in compliance with the legislation referred to in Italian law Legislative Decree no. 196/2003 and subsequent amendments – Privacy Code, to execute each purchase made through the Site and, subject to your consent, for any further activities as indicated in the specific privacy policy provided to the Consumer through the Site at the time of registration.

The Consumer declares and guarantees that the data provided to the Seller during the registration and purchase process are correct and truthful.
